This policy explains what personal data Mercury Group collects when you use this website or contact us, why we collect it, how long we keep it, and what rights you have over it. It applies to en.mercury.realestate and to the enquiries you send us through it.
1. Who is responsible for your data
The controller of your personal data is:
Mercury Group İnşaat ve Gayrimenkul Limited Şirketi
Çukur Mahallesi, Tarlabaşı Bulvarı No:150-170, İç Kapı No:13,
Beyoğlu / İstanbul, Türkiye
Tax office: Beyoğlu Vergi Dairesi · Tax number: 6170882554
Email: info@mercury.realestate
Mercury Group also operates through affiliated companies in other countries. Where an enquiry concerns a property or service handled by one of them, that company may act as a joint controller. Full corporate details of every entity in the group are published on our Requisites page.
2. Which law applies
We process personal data in accordance with:
- the General Data Protection Regulation (EU) 2016/679 (GDPR), where we offer services to people in the European Economic Area;
- the UK GDPR and the Data Protection Act 2018, where we offer services to people in the United Kingdom;
- Turkish Law No. 6698 on the Protection of Personal Data (KVKK), as a company established in Türkiye;
- the data protection law of any other country whose residents we serve, where that law applies to us.
Where these rules differ, we apply the standard that gives you the stronger protection.
3. What we collect
| Category | What it includes | Where it comes from |
|---|---|---|
| Contact details | Name, telephone number, email address, preferred language and messenger | You, through a form or a message |
| Enquiry details | What you are looking for: country, city, budget, type of property, timescale, purpose of purchase, answers you give in our questionnaires | You |
| Correspondence | Emails, messages and notes from calls and viewings | You and our staff |
| Transaction data | Information needed to prepare and complete a purchase, lease or service contract, including documents required by law | You, and public registers where the law requires a check |
| Technical data | IP address, browser and device type, pages visited, referring site, cookie identifiers | Automatically, when you use the site |
We do not ask for special category data — health, religion, political views, biometric or genetic data. Please do not send us such information unless we have asked for it because the law requires it for a specific transaction.
Our services are not directed at children, and we do not knowingly collect data about anyone under 16.
4. Why we use it, and on what legal basis
| Purpose | Legal basis |
|---|---|
| Answering your enquiry and advising you on properties and services | Steps taken at your request before entering into a contract (GDPR Art. 6(1)(b)) |
| Arranging viewings, preparing and performing a contract of sale, lease or service | Performance of a contract (Art. 6(1)(b)) |
| Meeting legal obligations, including anti-money-laundering and tax record keeping | Legal obligation (Art. 6(1)(c)) |
| Keeping the website secure and working, and understanding how it is used | Our legitimate interests in running and protecting our business (Art. 6(1)(f)) |
| Sending you offers and news about properties | Your consent (Art. 6(1)(a)), which you may withdraw at any time |
| Establishing, exercising or defending legal claims | Our legitimate interests (Art. 6(1)(f)) |
We do not make decisions about you by automated means alone, and we do not profile you in a way that produces legal effects.
5. Who we share it with
We share personal data only where it is needed for the purposes above:
- Companies within Mercury Group in Türkiye and other countries, where the enquiry concerns their market;
- Developers, property owners and landlords, where you ask us to arrange a viewing or make an offer;
- Professional advisers — lawyers, notaries, translators, surveyors and banks — where a transaction requires them;
- Service providers who work on our instructions: website hosting, email delivery, customer relationship management and analytics;
- Public authorities, where the law obliges us to disclose.
We do not sell personal data, and we do not share it for anyone else's marketing.
Every provider acting on our instructions is bound by a written contract that permits them to process your data only for us and requires appropriate security.
6. Sending data to other countries
Mercury Group operates in Türkiye, the United Arab Emirates, Russia and several European and Asian markets, so your data may be transferred outside the country where you live — including outside the European Economic Area.
Where we transfer data out of the EEA or the United Kingdom to a country without an adequacy decision, we rely on the Standard Contractual Clauses approved by the European Commission, together with any additional safeguards the transfer requires. Where Turkish law applies, we rely on the grounds for transfer abroad set out in Article 9 of the KVKK.
You can ask us for a copy of the safeguards that apply to a particular transfer by writing to the address in section 11.
7. How long we keep it
| Data | Kept for |
|---|---|
| Enquiries that do not lead to a contract | Up to 2 years from our last contact with you |
| Records of a completed transaction | As long as the law requires — normally 10 years from the end of the contract |
| Marketing consent and the messages sent under it | Until you withdraw consent, and 1 year afterwards as proof that it was withdrawn |
| Website technical logs | Up to 12 months |
| Cookies | See section 9 |
When a period ends we delete the data or anonymise it so that it can no longer be linked to you.
8. Your rights
You have the right to:
- be informed about how we use your data — that is what this document is for;
- access the data we hold about you and receive a copy;
- have it corrected if it is inaccurate or incomplete;
- have it erased, where we no longer need it and no legal duty requires us to keep it;
- restrict how we use it while a question about it is resolved;
- object to processing based on our legitimate interests, and to direct marketing at any time;
- portability — receive the data you gave us in a common machine-readable format, or have it sent to another controller;
- withdraw consent at any time, without affecting what we did lawfully before you withdrew it.
To exercise any of these, write to info@mercury.realestate. We answer within one month; if a request is complex we may extend that by two further months and will tell you why. There is no charge unless a request is manifestly unfounded or excessive.
If you are not satisfied with our answer, you may complain to a supervisory authority — in the EEA, the authority in the country where you live or work; in the United Kingdom, the Information Commissioner's Office; in Türkiye, the Personal Data Protection Authority (KVKK). We would rather you came to us first, so that we can put things right.
9. Cookies
We use cookies and similar technologies to make the site work, to remember your preferences and to understand how the site is used. Cookies that are strictly necessary for the site to function are set automatically. Any others are set only with your agreement, which you give through the notice shown when you first visit and can change at any time in your browser settings.
Blocking cookies will not stop you browsing the site, but some parts of it — saved searches and forms in particular — may not work as intended.
10. How we protect your data
We use technical and organisational measures appropriate to the risk: encrypted connections to the website, restricted access to systems on a need-to-know basis, written confidentiality obligations for staff and contractors, and regular review of who holds access. No system is completely secure, but we take these obligations seriously and will notify you and the relevant authority if a breach is likely to put your rights at risk.
