These Terms govern your use of en.mercury.realestate (the "Site"), operated by Mercury Group İnşaat ve Gayrimenkul Limited Şirketi ("Mercury Group", "we", "us"), Çukur Mahallesi, Tarlabaşı Bulvarı No:150-170, İç Kapı No:13, Beyoğlu / İstanbul, Türkiye, tax number 6170882554.
By using the Site you accept these Terms. If you do not accept them, please stop using the Site.
1. What this Site is for
The Site presents Mercury Group's services and the properties and goods we offer, and lets you send us an enquiry. Our services include:
- sale and purchase of residential and commercial property;
- letting and rental management;
- off-market residential and commercial portfolios;
- turnkey renovation, design supervision and engineering works;
- supply of furniture, sanitary ware and household equipment;
- legal support for transactions, including assistance with residence permits and citizenship by investment.
2. Information on the Site is not an offer
Descriptions, photographs, floor plans, availability and prices are published for information. They do not constitute an offer capable of acceptance, and nothing on the Site creates a contract between us.
Property markets move quickly. A property shown as available may be reserved or sold, and a price may change, before we are able to update the Site. Prices are shown in the currency indicated and exclude taxes, duties, notary and registration fees unless expressly stated.
Any binding terms — price, payment schedule, completion date, scope of works — are agreed individually and set out in a signed contract.
3. Enquiries
When you send an enquiry, you are asking us to contact you. You agree to give accurate contact details so that we can reply.
We aim to respond promptly but do not guarantee a fixed response time. Sending an enquiry does not reserve a property and does not oblige either of us to enter into a contract.
We may decline to act on an enquiry that is abusive, obviously false, or that we are prevented from accepting by law, including sanctions and anti-money-laundering rules.
4. Using the Site
You may view the Site and use its material for your own personal, non-commercial purposes. You may not:
- copy, republish or distribute the Site's content for commercial purposes without our written permission;
- extract data from the Site systematically, by automated means or otherwise, to build a database or a competing service;
- interfere with the working or security of the Site, or attempt to gain unauthorised access to it.
5. Intellectual property
The Site's text, photographs, video, design, layout, logos and software are owned by Mercury Group or used under licence, and are protected by copyright and trade mark law. Photographs and plans of properties may belong to developers or owners and are published with their permission.
You may quote short extracts with a clear credit and a link to the source page. Anything more requires our written consent.
6. Third-party sites and content
The Site links to third-party resources, including video hosting, maps and developers' own pages. We do not control them and are not responsible for their content or their privacy practices. Following such a link is at your own discretion.
7. Availability and liability
We take reasonable care to keep the Site accurate and available, but we provide it "as is". We do not warrant that it will be uninterrupted, error-free or free of harmful components, and we may suspend it for maintenance.
To the extent permitted by law, we are not liable for indirect or consequential loss, or for loss of profit, arising from your use of the Site or your inability to use it. Nothing in these Terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, or for fraud.
These limits apply to the Site itself. Our responsibility under a signed contract for a property or a service is governed by that contract.
8. Personal data
We process personal data as described in our Privacy Policy, which explains what we collect, why, how long we keep it and what rights you have under the GDPR and Turkish Law No. 6698 (KVKK).
9. Changes
We may amend these Terms. The date at the top shows when they were last revised, and the version published on the Site applies to your use of it. If a change is significant, we will draw attention to it on the Site.
10. Governing law and disputes
These Terms are governed by the law of the Republic of Türkiye. The courts of Istanbul have jurisdiction over any dispute arising from the Site.
If you are a consumer resident in the European Economic Area or the United Kingdom, this choice of law does not deprive you of the protection of mandatory consumer rules of the country where you live, and you may bring proceedings in the courts of that country.
